What to expect when bringing a lawyer into an employment matter

When people ask me, what do I expect if I’m gonna bring a lawsuit for this employment matter that happened to me, here’s what I usually say.

So number 1

We start by sending a personnel file request.

California does a good job of protecting its consumers and its employees from wrong doings by employers.

So there’s a provision in the labour code that allows you to have access to your employment file and your pay records so that you can evaluate what’s documented in my file.

So, we send those requests out and we get them back and usually we work closely with the plaintiff to draft a complaint, which is essentially the lawsuit that will get filed in court and served on the defendant.

Once that happens, you enter into the discovery process where written discoveries exchange written questions that each side has to answer, and the deposition process where actual witnesses get put under oath and get asked questions about what happened.

Ultimately that process can be relatively long, because the law moves fairly slowly, but we’re here to guide you through that process.

And it often, when it doesn’t resolve, ends in a trial, which is where you’re trying your case before a judge or a jury.
