SLG Defeats Motion for Summary Adjudication

On April 7, 2017, SLG defeated a motion for summary adjudication brought by the defendant doctor in a medical malpractice action. ย SLG’s client, Nader Zeighami, received a LASIK procedure fromย the doctor that left Mr. Zeighami with monovision. ย Mr. Zeighami did not consent to monovision, does not tolerate it, andย his vision now is permanentlyย impaired. ย SLG successfully added a medical battery claim to the complaint, which is not subject toย MICRA. ย The court deniedย the doctor’s motion for summary adjudication on the medical battery claim, concluding that triable issue of facts remain for the jury to decide. ย A copy of the court’s order isย here.

Trial is scheduled to begin on May 15, 2017.
