SLG Defeats Motion for Summary Adjudication

On April 7, 2017, SLG defeated a motion for summary adjudication brought by the defendant doctor in a medical malpractice action.  SLG’s client, Nader Zeighami, received a LASIK procedure from the doctor that left Mr. Zeighami with monovision.  Mr. Zeighami did not consent to monovision, does not tolerate it, and his vision now is permanently impaired.  SLG successfully added a medical battery claim to the complaint, which is not subject to MICRA.  The court denied the doctor’s motion for summary adjudication on the medical battery claim, concluding that triable issue of facts remain for the jury to decide.  A copy of the court’s order is here.

Trial is scheduled to begin on May 15, 2017.
